Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Elysia ("Elysia", "we", "us") and govern your access to and use of the Elysia website, applications, and services (the "Service"). By creating an account, making a purchase, or using the Service — including uploading content to an event as a guest — you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Elysia is a per-event platform for celebrations. It includes digital invitations and RSVP management, a seating planner, a shared photo, video, and audio album that guests contribute to, and optional AI-assisted design tools. Products are sold per event as one-time purchases; there are no subscriptions. The features available to you depend on the plan purchased for that specific event.

2. Eligibility and accounts

You must be at least 18 years old to create a host account or make a purchase. By using the Service you represent that you meet this requirement.

You are responsible for providing accurate account information, keeping your credentials confidential, and for all activity that occurs under your account. Notify us immediately at support@elysiaevents.com if you suspect unauthorized use of your account.

3. Purchases, pricing, and taxes

Payments are processed by Dodo Payments, our authorised reseller and Merchant of Record, which handles order processing, taxes, invoicing, refunds, and payment support for purchases; the charge on your statement appears as "DODOPAY" or "Dodo Payments". The price, currency, and features of each product are displayed at checkout and are charged once per event. Prices may change at any time, but changes never affect purchases you have already completed. Displayed prices include applicable taxes; any exception is shown at checkout before you pay.

Purchases unlock features for a single, specific event and are not transferable to another event or account.

A free plan is available for evaluating the Service. It is limited in features and retention, and you may hold up to 2 active free events at a time; a free event stops counting against that limit once its retention window ends. We may change the limits of the free plan, or withdraw it, at any time.

4. Refunds

We offer a full refund within 7 days of purchase, provided the purchased product has not been materially used: for the album, no more than 5 media items have been uploaded to the event; for RSVP and seating, your RSVP link has not yet collected responses. To request a refund, email support@elysiaevents.com from the address on your account.

Approved refunds are issued by Dodo Payments, our Merchant of Record, to the original payment method and typically appear within 5–10 business days depending on your bank. AI credits that have already been consumed are not refundable. Nothing in this section limits any non-waivable refund or cancellation rights you have under applicable consumer-protection law.

5. Your content and license to us

You and your guests retain all ownership rights in the content uploaded to your event, including photos, videos, audio, guest lists, and designs ("Content"). We claim no ownership in your Content.

So that we can operate the Service, you grant us — and you confirm your guests grant us — a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process (for example, to generate thumbnails and previews), display, and back up Content solely for the purpose of providing the Service to you. This license ends when the Content is deleted, except for residual copies in backups, which are removed within 30 days.

We do not use your Content to train AI models, and we do not sell your Content or share it for advertising.

You represent that you have the necessary rights to the Content you upload and that it does not infringe the rights of any third party.

6. Hosting an event and your guests

As a host you control your event: who receives the link, whether uploads are moderated, whether the gallery is public, and when content is removed. You are responsible for the event you run, including obtaining any consent required from your guests for collecting their RSVP details and photos, and for using guest contact details only in connection with the event.

Guests upload without an account, under the event they were invited to. Guest contributions are subject to these Terms and to the host’s moderation decisions.

Invitations, reminders, and RSVP links you send through the Service go out under your name — by email sent by us on your behalf, or by opening a message in your own WhatsApp or messaging account. You are responsible for having a lawful basis to contact each recipient, for complying with the anti-spam and messaging rules that apply to you and to the channel you use, and for honouring opt-outs. Under data-protection law you are the controller of your guest list and we are your processor, as set out in our Privacy Policy.

7. Acceptable use

You may not use the Service to:

  • upload or share content that is illegal, defamatory, or harassing, or that infringes intellectual-property, privacy, or publicity rights;
  • upload or share any sexual content involving minors — this is reported to the relevant authorities and results in immediate termination;
  • upload malware or content designed to disrupt the Service;
  • circumvent plan limits, rate limits, moderation, or security measures, or probe or scrape the Service;
  • impersonate another person, or use guest contact details for unsolicited marketing unrelated to the event;
  • resell or commercially exploit the Service without our written agreement.

We may remove content and suspend or terminate accounts that violate this section.

8. Copyright and content complaints

If you believe content on the Service infringes your rights, email support@elysiaevents.com with a description of the work, the location (URL) of the material, your contact details, and a statement that you believe in good faith the use is unauthorized. We review complaints promptly, remove infringing material where appropriate, and terminate repeat infringers.

9. AI features

AI design tools and the support assistant are powered by third-party model providers. Inputs you submit are sent to the relevant provider solely to generate your result. AI output can be inaccurate or resemble other works; you are responsible for reviewing output before relying on it or printing it, and you must have the rights to any inputs you submit. We may decline prompts that violate these Terms or provider policies. AI image generation consumes credits; consumed credits are non-refundable.

10. Availability, retention, and backups

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation, and the Service may be briefly unavailable for maintenance.

Your plan includes a retention window for the event. It starts the day after your event date, not on the day you pay, so you can buy as far in advance as you like without losing time. If you have not set an event date, the window starts instead when your album is first used in earnest (5 uploaded items, or 250 MB) or 90 days after you created the event, whichever comes first. For an event created very far ahead of its date, the start is capped at 400 days after creation.

Until your album passes that usage threshold, the start date follows your event date: correcting the date moves the window, in either direction. Once the threshold is passed the start date is fixed, and later changes to your event date do not move it.

Album media is kept for the period included in your plan, measured from that start — currently 7 days on the free plan, 90 days on Pro, and 1 year on Premium. The event is then archived: guests can no longer view it or add to it, and you have 14 days to download everything as a single ZIP before the media is permanently deleted. Buying a plan for an archived event during those 14 days reopens it with its content intact.

RSVP and seating run on their own clock. Guest RSVP details — names, email addresses, phone numbers, and dietary or free-text notes — are kept for 30 days on the free RSVP plan and 18 months on the paid RSVP plans, measured from the same start, and are then irreversibly anonymised; headcounts survive, the personal details do not, and existing invite links stop working. Seating layouts are deleted 5 years after the start. Export anything you need before those dates.

Deletion and anonymisation — whether automatic at the end of a window, or triggered by you — are irreversible, and we cannot restore the data afterwards. The Service is not a backup or archival service: you are responsible for keeping your own copy of anything you cannot afford to lose, and for downloading your album before your window ends. We may change the retention periods for future purchases, but not for a plan you have already bought.

11. Suspension and termination

You may delete your account at any time from the dashboard; this permanently deletes your events and media. We may suspend or terminate access where these Terms or applicable law are violated, where required by law, or in the event of a payment dispute or chargeback, and we will notify you by email where reasonable. Sections 5, 12, 13, 14, and 16 survive termination.

12. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are a software service: we are not responsible for the conduct of your guests, the outcome of your event, or content decisions made by hosts.

We are not liable for any failure or delay caused by events outside our reasonable control, including outages or changes at our hosting, storage, payment, messaging, or AI providers, network or internet failures, venue connectivity, acts of government, or force majeure. Where such an event prevents us from providing a product you paid for, your remedy is a refund of the amount you paid for that product.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data (beyond the retention we committed to), or goodwill, arising out of or related to the Service. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us for the affected event in the 12 months before the claim arose, or (b) USD 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnification

You will indemnify and hold us harmless from claims, damages, and reasonable expenses (including legal fees) arising from Content you or your guests upload, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

15. Changes to the Service or these Terms

We may modify the Service or these Terms. For material changes to these Terms we will give at least 14 days’ notice by email or in-app before they take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, stop using the Service and contact us about a pro-rated resolution for unused purchases.

16. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules, and the competent courts of Tel Aviv-Yafo have exclusive jurisdiction — except where the mandatory consumer-protection law of your country of residence grants you rights or a venue that cannot be waived, in which case those rights are unaffected.

17. General

These Terms are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms are offered in multiple languages for convenience; if translations conflict, the English version prevails to the extent permitted by law.
